Standard Process for FCRA Registration for NGOs
Register an NGO in any of these Forms in India:
Trust Registration
A Trust can be set up when the settler of the property transfers it or its benefits for the well-being of the recipients, or in the public interest. This NGO is registered with the main aim of utilizing the asset of the Trust for a social cause, or public welfare. This is called a Charitable Trust. You can never have its fixed beneficiary because it is the massive public as a whole. It’s irrevocable unless the court interferes.
Society Registration
It has the Memorandum of Association and Rules and Regulation or bylaws. The society registration process requires it to be registered with the Registrar of Society or Commissioner of Trusts, which is appointed by the State Government. Its MOA can be updated while increasing or decreasing the aims or working overtime. This NGO must inform the registrar about the changes in its objectives every year. It can be shut under the termination clause in the Bylaws. Upon Its termination, the society can be absorbed or merged with the society having a similar aim.
Section 8 Company Registration
It requires MOA and AOA forms as the legal document of a Section 8 Company. Section 8 company registration is compulsory to file under the Central Government through the Registrar of Companies. It requires approval from the Registrar and has to undergo annual compliance.
TAN
For removing the tax from a source, the NGOs should apply for TAN number at any point of time after its registration.
GST Registration
If its research activity or consultancy work’s gross revenue exceeds the basic exemption limit of the Goods and Services Tax, it requires GST registration in India.
Professional Tax
NGO is liable to pay Professional Tax, which is deducted from the pay of an employee and deposited to the Government. It is governed by a state government and thus, its governance differs per state that comes with its own set of rules and regulations for Professional Tax.
Shops and Establishment License
As per the Indian NGO laws, if an NGO employs anyone for any work pertaining to the organisation it shall procure a license under the Shops and Establishments Act.
